Tribunal's reasoningAt a preliminary hearing on 7 January 2021, Employment Judge D Hoey ordered the claimant to show cause within 14 days why he had not attended the hearing. The Tribunal therefore struck out the claim under rule 37 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the ground that it had not been actively pursued.
