He said he had psoriatic arthritis, which he relied on as a disability under section 6 of the Equality Act 2010. The hearing on 13 October 2025 was a preliminary hearing to determine limitation and jurisdiction, rather than the merits of the discrimination allegations.
The tribunal found that the relevant date for time purposes was 18 July 2024, when the claimant resigned with immediate effect and the parties had reached an agreement about him leaving with a payment. It accepted that there had been back-to-work meetings and later discussions, but it rejected the proposition that the occupational health report, the subject access request, or the later payment dates amounted to a separate act of discrimination or changed the date from which time ran. On that basis, the claim was already out of time before ACAS early conciliation began.
Applying section 123 of the Equality Act 2010, the tribunal held that the ET1 had been presented about 170 days after the dismissal date used as the last act, and therefore about 70 days late even allowing for early conciliation. It considered the claimant's explanation that he needed support, lacked knowledge, had relied on his sister-in-law, and said he only appreciated matters after an occupational health report, but found those reasons insufficient to justify a just and equitable extension of time. The claim was therefore dismissed for lack of jurisdiction, and the extension application was dismissed as not well founded.
