Tribunal's reasoningMrs Michelle Nicholson was employed by Orbinox UK Limited as Finance Manager from 24 August 2023 until her employment was terminated on 7 December 2023. The tribunal recorded that the parties agreed she was owed two days' accrued holiday pay at the end of employment, and that this amounted to £340 gross. Applying regulation 14 of the Working Time Regulations 1998, the tribunal found that claim well-founded and ordered the respondent to pay £340 gross.
The separate breach of contract claim related to an alleged bonus. The claimant said she had been promised a bonus calculated by reference to 10% or 15% of salary and relied on an accruals figure in the respondent's accounts. The tribunal accepted the respondent's case that the offer letter made any bonus available only after completion of the three-month probationary period and in any event described it as discretionary. As there was only a short period between the end of probation and dismissal, and the respondent declined to exercise its discretion to pay a bonus, the tribunal held there was no right to additional bonus payment and dismissed that claim.
