Tribunal's reasoningThe tribunal considered at a preliminary hearing whether the claimant was a disabled person at the material times. It found that the claimant had anxiety and depression, and that these had a substantial adverse effect on normal day-to-day activities, including social withdrawal, sleep disruption, lethargy, mood changes, low self-esteem, and difficulty with personal hygiene and household chores.
The tribunal found that the substantial adverse effects were not long-term before 1 February 2023. By that date, given the duration of the absence, the continuing symptoms, and the lack of evidence that improvement was imminent, it found that the effects were likely to last 12 months. The claimant was therefore found to be disabled only from 1 February 2023, and the disability discrimination claims relating to the earlier period and the reasonable adjustments allegation were dismissed.
The claimant's breach of contract and/or unlawful deduction from wages claim was dismissed on withdrawal. The judgment did not make any monetary award.
