Tribunal's reasoningThis was a reserved judgment following a preliminary hearing about disability status for the purposes of section 6 of the Equality Act 2010. The claimant had brought claims including constructive unfair dismissal and discrimination because of disability, sex and/or pregnancy or maternity, but this judgment determined only specified preliminary disability issues.
The Tribunal found that the claimant was disabled by reason of Long Covid between 24 July 2022 and the end of January 2023. It found that the Covid-related impairments had an adverse effect on normal day-to-day activities, that those effects were substantial, and that viewed objectively at the relevant time they were likely to last at least 12 months.
The Tribunal found that the claimant was not disabled by reason of ligament injuries to her thoracic spine at any relevant time, so that element of the disability discrimination claim was dismissed. The question whether the claimant's partner was disabled for the purposes of the associated disability discrimination claim was left for determination at the final hearing unless otherwise directed.
