The tribunal found that the claimant's total gross weekly wage, including pension contribution, was £432. It accepted that he had worked a week in hand when his employment began and had not been paid that sum on termination. It also found that after being told on 12 February 2024 that there was no work and he was being laid off, the claimant received only £110, which was deducted from the unpaid wages award.
The tribunal found that the respondent had no contractual right to lay off the claimant. It concluded that employment terminated around 17 March 2024 when the claimant received his P45, and awarded three weeks' statutory notice pay. Given the claimant's age and complete years of service at dismissal, it also awarded statutory redundancy pay of 4.5 weeks' pay.
