Tribunal's reasoningThis is a remedy judgment following an earlier Reserved Judgment promulgated on 27 January 2025, in which the claimant's complaint of victimisation against Sheffield City Council was upheld (referred to at paragraph 4 of that judgment as 'the successful complaint'). The remedy hearing was held at Sheffield on 24 October 2025 before Employment Judge Brain sitting with Mrs J Hiser and Mrs G Fleming.
The Tribunal recommended, with a view to obviating or reducing the adverse effect on the claimant of the successful complaint, that the respondent provide training to senior managers (including Elyse Senior-Wadsworth) on the provisions of the Equality Act 2010, to include sections 27 and 39(4), by 24 October 2026. The Tribunal awarded £8,000 for injury to feelings caused by the successful complaint.
The Tribunal further found the respondent to have acted in breach of the ACAS Code of Practice 1 (Disciplinary and Grievance Procedures) in respect of the successful complaint, and considered it just and equitable to increase the injury to feelings award by 10%, adding £800. Interest of £1,056 was awarded pursuant to the Employment Tribunals (Interest on Awards in Discrimination Cases) Regulations 1996 at 8% per annum over 18 months on the sums in paragraphs 2 and 3. The total amount payable was £9,856.
