The claimant's application said he had resigned in writing on 22 January 2025 after non-payment and exclusion, and that when no wages or work followed he resigned again on 13 February 2025 with two weeks' notice. The tribunal read that material as meaning the repudiatory breach said to justify the claim existed before presentation, but the employment itself did not formally end until 13 February 2025.
The tribunal held that the relevant date for jurisdiction was the date the employment was formally brought to an end. Because that date was after the claim form was presented on 22 January 2025, the tribunal said it had no jurisdiction to consider the unfair dismissal, breach of contract and statutory redundancy payment complaints. It also rejected the argument that the claimant had not responded to the strike-out warning, noting that the 19 July 2025 email did not show that employment had ended, or that notice had been given, before presentation of the claim.
Having considered the application and the interests of finality in litigation, the tribunal was not satisfied that there was any reasonable prospect of the original decision being varied or revoked, and the application for reconsideration was refused.
