Tribunal's reasoningThe claimant worked for the respondent, a sole trader, as a sales assistant on his market stall for around six or seven years. The respondent told her on 23 September 2023 that he was going bankrupt, ceased trading, and the tribunal recorded that there was in law a presumption that the dismissal was by reason of redundancy.
The claimant presented her Employment Tribunal claim on 17 May 2024, outside the primary six-month time limit for referring the question of her right to a redundancy payment, but within the further six-month period. Employment Judge Lancaster held that it was just and equitable that she should receive a statutory redundancy payment and that the precondition for claiming under section 164(2)(c) had been satisfied.
The tribunal did not make a redundancy payment award in this judgment. It adjourned the proceedings because the claimant was not presently able to show that she was entitled to the ACAS early conciliation exemption relied on in her claim form, while noting that she could approach ACAS and submit a fresh claim.
