Mr H Roberts v Lancastrian Estates (Preston) Limited — 2025

Mr H Roberts brought a claim for a redundancy payment of £6,300.00 against Lancastrian Estates (Preston) Limited. The parties agreed that £6,300.00 was the correctly calculated redundancy payment. The respondent had already paid £1,676.80 towards that sum, and the tribunal therefore considered the balance outstanding.

The tribunal recorded that, at termination, there had also been a dispute about notice pay. The claimant had received £22,326.90 in respect of notice pay, subject to tax and national insurance deductions. The respondent later sought a tax refund from HMRC by retrospectively apportioning £6,300.00 of the notice pay as redundancy pay, and then passed £1,676.80 to the claimant.

The respondent did not attend the hearing. The claimant asked for a judgment for the remaining £4,623.20. The tribunal accepted the claimant's position that it was not open to the respondent unilaterally to re-classify notice pay already paid as redundancy pay, and it was not prepared to infer what the respondent's case would have been in opposition.

Judgment was entered for the claimant in the sum of £4,623.20 as the balance of the redundancy payment. The written notice also set out the tribunal interest information, including that the relevant decision day was 10 July 2025 and the stipulated rate of interest was 8% per annum, but no separate interest sum was awarded in the judgment itself.
