P Garcia v Ignite Group Services Limited (in creditors’ voluntary liquidation) and 1 other — 2025

The claim was presented in the Manchester Employment Tribunal on 3 February 2025. Because the respondents did not present a valid response on time, the Employment Judge said a determination could properly be made under rule 22 of the Rules of Procedure. The tribunal found that Ignite Group Services Limited was the claimant's correct employer and dismissed the claim against Justizia Technologies Limited.

On the substantive claims, the tribunal found a breach of contract in respect of notice for October 2024 and awarded gross damages of £7,083.33. It also found that the respondent had breached the contract of employment by failing to pay the relevant pension scheme the employee contributions deducted from the claimant's pay, and awarded £1,027.32 gross on that head.

The complaint in respect of holiday pay was found to be well-founded because the respondent had not paid the claimant for holidays accrued but not taken when employment ended, and a further gross award of £2,778.82 was made. The total award was £10,889.47 gross, and the judgment states that the claimant is responsible for any tax liabilities arising if the gross awards are paid without deduction at source.
