He alleged that the changes removed his role, responsibilities and authority, demoted him, and undermined his status, amounting to a fundamental breach of contract and the implied term of mutual trust and confidence.
The tribunal found that the support-function restructure did not remove the claimant's role or autonomy in the applications and packaging function, and that requests for help with support tickets were temporary, cross-organisational, and not compulsory. It concluded that the claimant had misunderstood what was being proposed, and that there was no breach of contract, fundamental or otherwise.
Because there was no repudiatory breach, the tribunal held that the claimant's resignation was not a dismissal. The constructive unfair dismissal complaint and the wrongful dismissal complaint for unpaid notice pay were both dismissed.
