Tribunal's reasoningThe tribunal dealt with a preliminary time-limit issue on Mr S Mohammad's unfair dismissal claim against HBOS Plc. It found that he was dismissed on 25 September 2024 and that the claim should have been presented no later than 12 February 2025, but was in fact lodged on 18 February 2025, six days late.
The claimant said it was not reasonably practicable to present the claim in time because of personal difficulties, including the death of his niece on 31 December 2024, family problems arising from divorce proceedings, and death threats received in mid-February 2025. The tribunal accepted that these matters were distressing and extended sympathy to the claimant, but found that he knew the deadline, had received an ACAS letter telling him of it, and had not sought or received medical treatment.
Applying section 111(2) Employment Rights Act 1996 and relying on Asda Stores Limited v Mrs S Kauser UK EAT 0165/07/RN, the tribunal held that stress or emotional and mental devastation was not enough to show that it was not reasonably practicable to present the complaint in time. It found that it would have been reasonably practicable for the claim to be brought within the statutory three-month period, refused to extend time, and dismissed the unfair dismissal claim without reaching the merits.
