On remedy, the tribunal held that the claimant was entitled to be paid for 40 hours at the national minimum wage rate applicable at the time, namely £11.44 per hour, rather than the £10 per hour he had been paid. That produced a total due of £457.60. The tribunal found there was no lawful reason for the non-payment and held that the respondent had made an unauthorised deduction from wages. It ordered payment of £457.60, less any deductions required by law for tax and national insurance contributions.
