Tribunal's reasoningBright HR Limited dismissed Mr S Cartledge on 22 April 2024 within section 95(1)(a) of the Employment Rights Act 1996. The Tribunal held that his claim of unfair dismissal under section 94 ERA 1996 was well-founded.
The Tribunal found that Mr Cartledge's employment would have ended on 7 June 2024 in any event. It therefore reduced his compensation under section 123(1) ERA 1996 so that his losses ended on that date. His claims for unpaid notice pay and unpaid commission were considered within the compensatory award for unfair dismissal; the award expressly included commission that would have been paid but for the unfair dismissal under section 123(2)(b) ERA 1996.
The Tribunal found that Mr Cartledge was not a disabled person within section 6 of the Equality Act 2010. His direct disability discrimination claim under section 13 EqA 2010 was consequently dismissed as not well-founded.
