Tribunal's reasoningThe tribunal struck out Ms Bennett's unfair dismissal claim under Rule 38(1)(a) of the Employment Tribunal Rules of Procedure 2024 because the claim form showed that she had been employed by Croydon Council from 15 February 2024 to 15 July 2024, which was less than two years' service. On 18 December 2024 the tribunal wrote to her explaining that, as a general rule, an unfair dismissal claim could not be brought without two years' service unless special circumstances applied, but no response was received within the seven days allowed. The tribunal therefore held that it did not have jurisdiction to consider the complaint of unfair dismissal.
