Tribunal's reasoningAt the London Central hearing on 21, 22 and 23 October 2025, Employment Judge Davidson dismissed the complaints of detriment for making protected disclosures and automatic unfair dismissal for making protected disclosures. Those whistleblowing claims were found not well-founded.
The tribunal upheld the breach of contract complaint in relation to notice pay. It awarded the claimant £5,000 in damages and stated that the figure was calculated using gross pay to reflect the likelihood that the claimant would have to pay tax on it as post-employment notice pay.
The tribunal also upheld the ordinary unfair dismissal claim. It found that the respondent had unreasonably failed to comply with the ACAS Code of Practice on Disciplinary and Grievance Procedures 2015 and increased the compensatory award by 25% under s 207A of the Trade Union and Labour Relations (Consolidation) Act 1992.
