On victimisation, the Tribunal found that the pleaded acts amounted to detriments, but that the respondent had not previously indicated support for the claimant's partial exemption application and that none of the detriments was because of protected acts. It found the adverse recommendation and notice of failure of probation were based on documented teaching concerns which predated the protected acts.
Because none of the complaints was proven, the Tribunal did not go on to determine the time limit issues. No remedy was awarded in the liability judgment.
