Miss K Rix v Prince of Wales Road Dental Practice — 2025

The tribunal issued a judgment by consent following agreement between the parties at a hearing before Employment Judge Murdoch at Norwich (by CVP) on 10 March 2025. The parties agreed that the respondent had made an unauthorised deduction from the claimant's wages in the period 1-30 September 2024 and would pay the gross sum of £1,380.11 representing the deducted pay, together with a net sum of £236.92 to compensate for financial loss in the form of daily interest over a six-month period based on a £1,300 overdraft attributable to that deduction.

The parties further agreed that the respondent would pay the claimant a net sum of £88.82 as damages in relation to the cost of replacing a birth certificate (£38.50) and a change of name certificate (£50.32). The total sum payable by the respondent to the claimant was a gross figure of £1,787.29, comprising £1,380.11 for the unauthorised deduction from wages and £407.18 representing the grossed-up figure of the combined net sums of £236.92 and £88.82, to be paid by 24 March 2025.

Upon the parties agreeing terms of settlement, and by consent, all proceedings were stayed until 4pm on 31 March 2025, at which time without further order they were to be dismissed upon withdrawal by the claimant unless either party notified the Tribunal before that time that it did not wish the judgment to take effect.
