Tribunal's reasoningAt a public preliminary hearing, the Tribunal considered whether two emails sent by the claimant on 30 August 2024 contained protected disclosures within s43B Employment Rights Act 1996. The Tribunal found that the claimant made three protected disclosures in the 13.13 email, relating to mismanagement of staff, workloads and recruitment, bullying, and transphobic comments and behaviour.
The Tribunal held that the claimant's claim for automatic unfair dismissal for having made protected disclosures may proceed to the final hearing. It did not decide whether the dismissal was because of the disclosures.
The respondent applied for a deposit order on the basis that the claimant had little reasonable prospect of establishing causation. The Tribunal refused the application, finding that the claimant had more than little reasonable prospect of establishing her case, taking it at its highest, and that key factual matters remained disputed.
