Mr M Sheerin v Airvending Limited — 2025

This decision concerns Mr M Sheerin's application dated 3 July 2025 for reconsideration of the Tribunal's earlier decision on his anonymity application. The Tribunal noted that the anonymity and restricted reporting application had been heard on 11 June 2025 and refused by case management order sent to the parties on 30 June 2025.

The Tribunal referred to rule 68 of the Employment Tribunal Procedure Rules 2024, which allows reconsideration of a judgment where necessary in the interests of justice, and to the definition of a judgment in rule 2(1). It recorded that decisions which do not finally determine the claim, or part of the claim, include case management orders and applications under rule 49 for privacy, anonymity or restricted reporting orders.

Relying on that framework and AEL v Flight Centre (UK) Ltd [2024] EAT 116, the Tribunal held that the claimant's reconsideration application related to a case management order and the refusal of the anonymity application, and therefore could not be reconsidered under rules 69 to 71. The application for reconsideration was refused by Employment Judge Tegerdine Date on 16 July 2025.
