Tribunal's reasoningBy a letter dated 2 July 2025, the Tribunal gave Ms S El-Raie an opportunity to make representations on why her unfair dismissal complaint should not be struck out because she appeared to lack the two years' continuous employment usually required to bring such a claim. The claimant provided written representations and did not request a hearing, so Employment Judge Dick determined the issue on the papers.
The Tribunal accepted the claimant's clarification that the claim was against Cranfield Solutions Limited and considered her further clarification about the dates of employment. It found that nothing in the claim form or written representations suggested that any exception to the usual rule in s 108 Employment Rights Act 1996 applied. The Tribunal held that Ms El-Raie had not been continuously employed for not less than two years and that it therefore had no jurisdiction to consider the complaint of unfair dismissal.
The judgment also notes that, reading the claim form as a whole, there appeared to be a separate claim for one week's notice pay following the claimant's resignation because of what she said was the respondent's repudiatory breach of contract. That claim was not affected by this judgment and was said to be capable of being pursued separately, with separate directions made about it. The judge added that, if successful, that notice pay claim was unlikely to exceed one week's wages.
