Tribunal's reasoningThe claimant brought a claim for a statutory redundancy payment, naming Mr John Wardle as respondent. The early conciliation certificate had named a different prospective respondent, Youngstars Nurseries (Addlestone) Limited, at a different address. The tribunal observed that the claim should not have been accepted in those circumstances but had been accepted in error, and that the claim had not come to Mr Wardle's attention because he did not live at the address provided.
Following a review, the claimant was written to on 26 November 2025 asking her to confirm the correct name of her former employer, and again on 29 December 2025 warning that a Legal Officer was considering striking out the claim for want of active pursuit. She did not respond to either letter and did not attend the hearing on 7 January 2026, although Mr Wardle attended. The tribunal clerk made enquiries by telephone before the hearing without success.
The tribunal dismissed the claim against Mr Wardle under rule 47 of the Employment Tribunal Rules of Procedure. For completeness, it recorded that any outstanding statutory redundancy payment, on the figures in the claim form, would be £1,300.25 (seven weeks' pay at £185.75, based on a monthly figure of £804.92), and noted that such a sum could be claimed from the Redundancy Payment Service subject to that scheme's requirements.
