Tribunal's reasoningThe tribunal recorded that the respondent was in compulsory liquidation, and on 17 January 2024 the claimant was told that consent of the court dealing with the liquidation proceedings would be required before the claim could proceed. The claimant later said on 11 August 2024 that steps were being taken to obtain that consent.
On 19 September 2024 the tribunal directed the claimant to provide a further update by 31 October 2024. No update was received. A reminder was then issued on 5 November 2024 asking for an update by 12 November 2024, and no reply was received.
A letter dated 15 November 2024 warned that the claim was proposed to be struck out because it had not been actively pursued, and the claimant was given until 29 November 2024 to explain why that should not happen or to request a hearing. The judgment notes that this letter was issued in error because a Legal Officer did not have delegated authority to order strike out.
The tribunal then gave the claimant a further opportunity on 4 December 2024 to provide written reasons by 11 December 2024 or request a hearing. The claimant did not provide an acceptable reason or request a hearing, and Employment Judge J McCluskey struck out the claim on 17 December 2024 under rule 37(1)(d) of the Employment Tribunals Rules of Procedure 2013 on the basis that it had not been actively pursued.
