Tribunal's reasoningThe claimant emailed the Tribunal on 17 April 2025 stating that he wanted to withdraw his tribunal request against the respondent. He said this was because he had been told that the respondent wanted to sort the matter out through ACAS with a binding agreement, and asked for the tribunal to be cancelled.
On 4 May 2025 the claimant sent a further email asking the Tribunal to disregard the earlier cancellation request and to let the case continue, saying his wage dispute was still ongoing and had not been resolved without a tribunal. That email did not reach the file before a Legal Officer issued a judgment on 6 May 2025 dismissing the claim under Rule 51.
Employment Judge M Kearns considered the Legal Officer's judgment afresh under Regulation 10A(2) of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013. The judge revoked the dismissal, held that the claimant's 17 April 2025 email had already brought case 8000917/2025 to an end under Rule 50, and recorded that the case was not dismissed. The judgment states that the claimant may bring a fresh claim if he wishes, and that the interests of justice favoured not dismissing the claim under Rule 51(b).
