The reasons record that the Tribunal wrote to the claimant on 11 February 2025 reminding them to lodge a schedule of loss and reply to the date-listing letter, but no response was received.
After the respondent applied for strike out and expenses on 19 February 2025, the Tribunal sought the claimant's comments on 20 February 2025 and again by a further request for comments on 20 February 2025 in relation to the respondent representative's correspondence. No reply was received. The Tribunal then sent a final reminder on 13 March 2025.
On 24 March 2025 the Tribunal issued a strike out warning letter giving the claimant an opportunity to confirm by 7 April 2025 whether they wished to pursue the claim and to make representations on the respondent's applications for strike out and expenses. The claimant did not respond, and the Tribunal therefore struck out the claim under rule 38(1)(d).
