Tribunal's reasoningMr Wilson was employed by The TBC Pub Company Limited as General Manager at The Bridge Inn, Ratho, from 10 March 2025 until his dismissal without notice on 7 May 2025. His contract provided for one week's notice after more than one month of employment. The tribunal found that his weekly pay was £961 gross and about £817.25 net, including payments from the tronc system.
The respondent said Mr Wilson had been dismissed for gross misconduct after staffing issues on 5 and 6 May 2025. The tribunal found that Mr Wilson had informed Mrs Banks that the assistant manager was unwell, asked for support or cover, and had a reason for not working additional hours because he had childcare responsibilities. It found that the respondent had wider concerns about his suitability for the General Manager role, but that the conduct relied on did not amount to gross negligence or gross misconduct.
The tribunal held that Mr Wilson was wrongfully dismissed because the respondent had not established a repudiatory breach entitling it to dismiss him summarily. It awarded £817.25 net for one week's notice pay, including the tronc payment which formed part of his salary.
The tribunal also found that Mr Wilson was paid only to 4 May 2025 although his employment ended on 7 May 2025, and that he had not received tips for the final week. It held that the unpaid £350 net pay for 5 to 7 May 2025 and £33 tips amounted to unlawful deductions from wages, and ordered the respondent to pay £383 for that claim.
