Tribunal's reasoningThe tribunal dealt with Mr Devlin's unfair dismissal claim at a preliminary hearing listed for 31 March 2025 to consider time bar. Mr Devlin did not attend. The tribunal asked him to confirm by 14 April 2025 whether he wished to pursue the claim, but no reply was received.
A strike out warning was issued on 28 April 2025 because he had not complied with the tribunal's order to confirm whether he wished to continue. He later wrote on 1 May 2025 asking whether he would have a chance of a successful outcome and whether he would be treated fairly. The tribunal replied that it could not provide advice on prospects of success and again asked him to confirm whether he wished to pursue the claim, but no reply followed.
On 30 May 2025 a 14 day strike out warning letter was issued, but that letter was sent in error because it did not tell the claimant that he could request a hearing. Legal Officer D Ellison directed that the error be corrected. The tribunal then gave the claimant until 21 July 2025 to provide written reasons why the claim should not be struck out or to request a hearing.
The claimant did not provide an acceptable reason or request a hearing, and the tribunal therefore struck out the unfair dismissal claim on the basis that it had not been actively pursued. No remedy was awarded because the claim was not determined on its merits.
