The tribunal found that the claimant believed he had completed all tasks, but further information was requested and an online portal link was resent because the checks had not been completed. Ms Thomas told the claimant that the start date had changed to 1 September and reminded him that the offer remained conditional on completion of the recruitment process, including satisfactory background checks. The tribunal also accepted that the changed start date was caused by insufficient numbers of people completing the recruitment process, making training for the original date no longer viable.
The tribunal considered the Employment Tribunals Extension of Jurisdiction (Scotland) Order 1994 and held that the claimant had to show that a contract was in place and that it had been breached. It found that the offer of employment was conditional, that the claimant knew it was conditional, and that the anticipated start date did not make the offer binding because the required checks had not been completed.
The tribunal concluded that no contract of employment had come into existence between the parties. Because there was no contract, there could not have been a breach of contract. The breach of contract claim was dismissed, and no damages were awarded despite the claimant having sought £4,820.
