It was agreed at an earlier Case Management Discussion that the Claimant was disabled at all material times by endometriosis and adenomyosis and that the Respondent had knowledge of those disabilities from 15 January 2018, following an Occupational Health report which recommended adjustments relating to access to toilet facilities and management of debilitating symptoms.
The Tribunal dismissed the Claimant's claims of harassment related to race (s26 EqA), direct race discrimination (s13 EqA) and unlawful deductions from wages (s13 ERA 1996). The breach of contract claim concerning unpaid mileage was withdrawn by the Claimant after the parties reached agreement during the hearing and was dismissed on withdrawal.
