Tribunal's reasoningAt a hearing in Exeter on 13, 14 and 15 November 2023, Employment Judge Goraj, sitting alone with the parties' consent, found that the claimant was a disabled person at the relevant time, 15 July 2022, because of osteoarthritis. The tribunal held that he was unlawfully discriminated against by the respondent in relation to his dismissal under sections 13, 15 and 39 of the Equality Act 2010.
The tribunal awarded compensation totalling £7,947.71. This comprised £6,494.66 for loss of earnings, which was reduced by 75% from 10 August 2022 to reflect the tribunal's finding that the claimant's employment would have terminated lawfully on 9 August 2022, interest on that loss of £346.38, injury to feelings of £1,000, and interest on the injury to feelings award of £106.67. The tribunal also recorded that the Employment Protection (Recoupment of Benefits) Regulations 1996 did not apply.
