Tribunal's reasoningThe respondent conceded that it had made unauthorised deductions from the claimant's wages. The tribunal ordered payment of 12 hours at £8.91 per hour, subject to the usual statutory deductions. It also found that, at all material times from the claimant's 26 April 2021 job interview through to her 3 June 2021 post-termination grievance, the claimant was a disabled person.
On the disability harassment claim, the tribunal found that the respondent harassed the claimant at a meeting on 5 May 2021 when a Deputy Manager said she would not get special treatment because of her mental health. The tribunal also recorded that the claimant's other harassment claims failed and were dismissed. Remedy for the upheld harassment claim was settled, the remedy hearing was stayed to allow the terms to be effected by 5 April 2022, and if no party applied to restore the hearing by 12 May 2022 the remedy claim would be dismissed on deemed withdrawal.
The victimisation claim was dismissed. The tribunal accepted that the claimant had done protected acts when she wrote to the respondent on 8 May 2021 about the 5 May meeting and when the CAB sent a formal grievance letter on her behalf on 3 June 2021, but it found that the respondent did not subject her to any detriment because of those protected acts.
