Tribunal's reasoningThe claimant did not attend the preliminary hearing on 30 June 2021. The Tribunal considered an email from 28 June explaining that the absence was because the claimant was unable to take time off work.
The Tribunal recorded that the claim had been presented out of time and that the onus was on the claimant to prove why the claim was not presented on 27 May 2020. In the claimant's absence, the hearing could not proceed.
The Tribunal noted that the notice of hearing had been sent well in advance on 7 January 2021 and that the claimant had been ordered to provide a witness statement seven days before the hearing but had not done so. Although mindful that obtaining leave from work can be difficult, the Tribunal decided it was fair and just to dismiss the claim.
