Sitting in Leeds on 2 and 3 October 2019, Employment Judge Maidment with members Mr W Roberts and Mr M Brewer found that the claims of racial harassment under section 26 of the Equality Act 2010 against the first respondent were well founded and succeeded.
The tribunal also found that Capita Retail Finance Services Ltd was not liable for the first respondent's act of harassment because, under section 109(4) of the Equality Act 2010, it had taken all reasonable steps to prevent that act.
