Tribunal's reasoningAt a hearing in Leeds before Employment Judge Lancaster with members W Roberts and M Taj on 22, 25, 26 and 27 April 2022, the tribunal struck out the claimant's direct race discrimination allegation that he had been paid less than Mr John George because the deposit ordered to be paid by 29 September 2021 had not been paid.
On the morning of Day 2, the two harassment claims and the direct race discrimination claim about being disciplined for allegations of aggressive/inappropriate behaviour were withdrawn and dismissed. The judgment recorded that the £900 in deposits paid for those three claims would be refunded to the claimant under rule 39(5) of the Employment Tribunals Rules of Procedure 2013.
