Mr Dean Davidson v NHS England — 2023

At a private preliminary hearing by telephone on 10 March 2023, the claimant clarified the claims he wished to continue. He confirmed that he no longer wished to pursue all of the claims previously identified in his ET1 and in the case management orders dated 16 December 2022.

The tribunal recorded that the claims of direct disability discrimination, victimisation, and one part of the harassment claim concerning Ms L Chan raising a grievance against the claimant were dismissed by consent on withdrawal. The judgment also recorded that the claimant would proceed with claims of indirect discrimination, discrimination arising from disability, failure to make adjustments, and the remaining parts of his harassment claims under separate case management orders.
