Key findings
Tribunal's reasoningThe tribunal unanimously held that Mr Gurung's claims of unfair dismissal and wrongful dismissal succeeded against Secured Guarding Ltd (in voluntary liquidation). It also held that victimisation in respect of the dismissal succeeded against both respondents, and that disability harassment succeeded on two separate sets of remarks: remarks made by Mr Thomas and Mr Yeboah against the First Respondent, and remarks made by Mr Hughes against both respondents.
All other claims of direct discrimination, harassment and victimisation, or otherwise, were dismissed. The judgment does not set out those dismissed claims individually beyond that general wording.
On remedy, the First Respondent was ordered to pay a basic award of £4,005 for unfair dismissal. The tribunal stated that the Recoupment Regulations did not apply because no compensatory award was made on that claim. For victimisation, the First and Second Respondents were ordered to pay £10,999.29 for financial loss, inclusive of £557.29 interest, plus £6,000 for injury to feelings. The First Respondent was further ordered to pay £1,500 for injury to feelings and £312.66 interest for one harassment claim, and the First and Second Respondents were ordered to pay £1,500 for injury to feelings and £317.92 interest for the other harassment claim.
