On that basis, the tribunal dismissed the claims against Bruton Restaurant Ltd (in voluntary liquidation), Season Dreams PLC and Project Re Ltd. The tribunal then found the complaint under s.23 of the Employment Rights Act 1996 that Project FZ Ltd had made an unlawful deduction from wages to be well founded.
The wages claim succeeded for unpaid net wages for April 2022 and May 2022, and Project FZ Ltd was ordered to pay £4,200. The tribunal also upheld the holiday pay claim and ordered £905.01 net, described as 9.33 times the net daily rate, in lieu of accrued but untaken annual leave.
The total sum payable by Project FZ Ltd was therefore £5,105.01 net. In addition, the tribunal made a declaration under s.12(3)(a) of the Employment Rights Act 1996 that Project FZ Ltd had failed to give the claimant pay statements in accordance with s.8 of the Employment Rights Act 1996 for the period 1 January 2022 to 1 May 2022.
