Tribunal's reasoningEmployment Judge B Smith, sitting with members Ms Campbell and Mr Greenland, gave a unanimous reserved judgment partially upholding the claimant's claims against the first respondent (Get My Slice Partners LLP) and second respondent (Mr O Southgate). Three discrete acts of unfavourable treatment because of something arising in consequence of disability under s.15 EqA 2010 succeeded against R1 and R2: not paying full monthly drawings during sickness absence (only SSP), cutting the claimant's expenses, and not communicating about starting SSP. Complaints against the third respondent (My Zero-One Technologies Limited) were dismissed.
All other discrimination claims (failure to make reasonable adjustments, direct marital status discrimination, direct race discrimination, harassment, victimisation) were not well founded and were dismissed. The unauthorised deductions from wages claim succeeded against R1 (£5,715.43 for May-July 2022 and £9,136.32 for the tax year 2021/22). The holiday pay claim also succeeded against R1, with a 25% uplift under s.207A TULR(C)A 1992 for unreasonable failure to comply with the ACAS Code of Practice on Disciplinary and Grievance Procedures.
