Mr R Eboikpomwen brought a race discrimination claim and several disability-related claims against the Department for Levelling Up, Housing and Communities and the individual respondents. The case was heard at London Central by CVP on 25 October to 2 November 2023 before Employment Judge Nicolle Non-legal with lay members Mr D Hearn and Ms J Tombs.

The claimant withdrew the race discrimination claim, and the judgment records that claim as dismissed on withdrawal. The tribunal then dealt with the disability-based allegations and found that the claims for discrimination arising from disability under s.15 Equality Act 2010, indirect discrimination on account of disability under s.19, and failure to make reasonable adjustments under s.20 all failed.

The tribunal also dismissed the claims for harassment on account of disability under s.26 and victimisation under s.27 against all respondents. Oral reasons were given on 2 November 2023. No monetary remedy was recorded in the judgment.
