At a preliminary hearing, the Tribunal found that the claimant had a disability as defined in section 6 of the Equality Act 2010 at the time of the events relevant to her disability discrimination claim, specifically anxiety and low mood.

The Tribunal refused the respondent's application to strike out the constructive unfair dismissal complaint, and also refused the alternative application for a deposit order in respect of that complaint. The respondent's application to strike out the claimant's reliance on two identified alleged protected disclosures as part of her whistleblowing complaint succeeded.
