The tribunal dismissed the direct race discrimination and harassment complaints. It accepted the respondent's explanations for the inadequate support, failure to review the claimant's support plan and the Lilt incident, and did not find that the relevant conduct was because of or related to race.

It found that the claimant's 5 July 2021 complaint alleging discrimination because of ethnicity was a protected act, was not made in bad faith, and that the respondent settled upon dismissal because of that protected act. The wrongful dismissal claim was dismissed because the tribunal rejected the claimant's argument about her contractual notice entitlement in the circumstances of her NQT period.
