The claim form had referred to discrimination but said the claimant was not sure whether it related to race, age or religion. The tribunal recorded that the respondent had asked for further particulars, that there was no evidence-in-chief in the claimant's witness statement, and that the case was a classic Madarassy v Nomura International plc situation: there was no more than a reference to protected characteristics and a difference in treatment, so the claim had no reasonable prospect of success and was not actively pursued.
The tribunal also struck out the claims for unfair dismissal and wrongful dismissal because they were presented out of time. The reasons state that the claimant was legally represented, that he was aware by 23 August 2021 that his appeal had been unsuccessful, and that he therefore had time to contact Acas before 8 September 2021 if he wished to pursue a claim. The reasons also note that a protected disclosure claim had previously been withdrawn in writing by the claimant's representative and that the claimant attempted to resurrect it. No compensation or other remedy was awarded.
