Tribunal's reasoningThe claimant, a licensed Christian Science Nurse, brought complaints against Mrs Audrey Sentinella and The First Church of Christ, Scientist, which accepted that it was a qualifications body for the purposes of sections 53 and 54 Equality Act 2010. The complaints concerned a May 2021 webinar about Charton Manor's accreditation, the removal of the claimant's card from the Christian Science Journal in May 2023, and the lack of a substantive response to her July 2023 complaint.
The Tribunal dismissed all complaints. It did not find that any discrimination complaints were because of race or sex, or that any harassment complaints were related to race or sex. It also held that the webinar discrimination complaint and the harassment complaints did not fall within the scope of section 53 Equality Act 2010, and that the webinar complaint was out of time with no basis for a just and equitable extension.
The Tribunal noted that the decision to remove the claimant's card had been made by the Board of Directors, while Mrs Sentinella had recommended removal. It added that, following the decision, the Church should recognise its status as a qualification body and have appropriate processes for removing a card and providing a right of appeal, but those observations did not alter the dismissal of the complaints.
