The Tribunal found that the last date for presenting the claim was 9 August 2023, so the claim was approximately three months out of time. It found that reliance on internet AI advice and lack of knowledge of the one-month deadline after the early conciliation certificate did not provide a reasonable explanation for the delay.
The Tribunal declined to extend time and held that it had no jurisdiction to hear the claim, which was struck out. It also stated that, had time been extended, the 2014 allegations would have been treated as isolated acts and out of time, while some 2022 and 2023 allegations would have been allowed to proceed.
