Mr O Kolawole v LJ Health and Wellbeing Ltd and 1 other — 2024

Mr Kolawole succeeded in his unpaid wages claim against LJ Health and Wellbeing Ltd. The tribunal found that he worked from 7 October to 13 November 2023, completing 20 night shifts of 9 paid hours each at £12 per hour. On that evidence he earned £2,160, had been paid £168, and was owed £1,992 in unpaid wages.

The tribunal also accepted that holiday pay formed part of his wages. It calculated that he had accrued 21 hours of holiday over a five-week period, worth £252 at his hourly rate, and added that sum to the unpaid wages to reach a total award of £2,244. The first respondent was ordered to pay that amount immediately. Jacksonwell Recruitment Limited was dismissed from the claim because Mr Kolawole had ceased working for LJ Health and Wellbeing Ltd before Jacksonwell Recruitment was incorporated, so there was no basis for a claim against it.

Neither respondent submitted a valid response on time, so the claims were not defended. The reasons note that Mr Kolawole said the non-payment caused significant financial hardship for him and his family, and that he may need to take enforcement steps if the award is not paid. A notice accompanying the judgment stated that if the sum remains unpaid after 14 days from the relevant decision day of 22 October 2024, interest may accrue at 8% per annum under the Employment Tribunals (Interest) Order 1990.
