Mrs K Rogers v Carewatch Care Services Limited — 2017

The tribunal heard the case on 1 August 2017 before Employment Judge T Vincent Ryan. It first amalgamated the duplicate proceedings and dismissed claim number 3401024/2016 without prejudice to the claims proceeding under 2404338/2016.

On the respondent's application for deposit orders, the tribunal held that the claimant had little reasonable prospect of success on two claims. The first concerned alleged race and disability discrimination and harassment arising from email correspondence changing shifts and required availability for work. The second concerned alleged direct race and disability discrimination in relation to the respondent's handling of the claimant's formal grievance of 11 August 2016 and the alleged failure to sanction those named in the grievance.

A deposit order of £250 was made in respect of each of those two claims. The respondent's application for deposit orders on the remaining four claims was dismissed because the tribunal did not find that the claimant had little reasonable prospect of success. The judgment was given orally, with written reasons not provided unless requested.
