Tribunal's reasoningMr B Webster applied for interim relief in relation to his protected disclosure dismissal complaint against Diamond Bus (North West) Ltd. At a remote public hearing in Manchester on 16 June 2021, before Judge Brian Doyle sitting alone, the tribunal refused the application. It held that it did not appear likely that, on determining the complaint at final hearing, the tribunal would find that the reason or principal reason for dismissal was a reason specified in section 103A of the Employment Rights Act 1996.
The tribunal also ruled that without prejudice correspondence dated 1 June 2020, arising during ACAS conciliation, was not admissible at the final hearing. The judgment was limited to the interim relief application and did not decide the substantive dismissal or other listed claims, which were to proceed to the final hearing listed for 13 to 17 September 2021.
