Key findings
Tribunal's reasoningAt a preliminary hearing, the tribunal found that the claimant had an anxiety disability within the meaning of section 6 of the Equality Act 2010. The tribunal found that this disability began on 30 June 2022 and that before that date the claimant did not have an anxiety disability.
The tribunal struck out the harassment complaints identified at paragraphs 6.1 to 6.6 and 6.8 of the List of Issues on the ground that they had no reasonable prospect of success. The judgment stated that this did not adversely affect the claimant's ability to pursue the harassment complaints at paragraphs 6.7 and 6.9, direct discrimination because of hearing impairment disability, and failure to make adjustments.
