Tribunal's reasoningThe claimant worked in the respondents' hospitality business from 21 November 2022 to 27 November 2023. She is bipolar and has ADHD and was found to be disabled within section 6 of the Equality Act 2010. She complained of harassment related to her disability under section 40 of the Equality Act 2010. The respondents did not present a response, and the matter was decided under Rule 21 on the information before the Judge.
On the evidence provided and having considered comparable case law, the Judge found the complaint well founded and assessed injury to feelings in the middle Vento band at £25,000. The claimant resigned as a consequence of the unlawful harassment and suffered wage loss; actual wage loss was calculated at £14,273.75 and future wage loss at £2,936.24 (three months at a net monthly loss of £978.98).
A 25% uplift of £10,552.50 was applied to the injury to feelings and wage loss components for failure to follow the ACAS Code of Practice on disciplinary and grievance procedures. Interest at 8% was awarded on injury to feelings (£2,219.17) and on actual wage loss (£631.95). A gross-up of £6,403.40 was added so the claimant would receive the net amount owed after income tax on the portion exceeding the £30,000 tax-free threshold.
